Commercial warranty and statutory rights

This commercial warranty describes Cyrusher’s voluntary coverage for eligible defects. It does not replace or restrict the statutory legal guarantee of conformity that applies to consumers under applicable law.

Warranty scope

This warranty does not cover damage or defects caused by failure to follow the owner’s manual, natural events, accident, misuse, neglect, abuse, commercial use, alterations, modifications, improper assembly, normal wear and tear, incompatible parts or accessories, operator error, water damage, extreme or stunt riding, or improper aftercare.

Under the commercial warranty, a complete bicycle replacement is provided only when repair or replacement of eligible components is not a reasonable solution. This rule does not limit the consumer’s statutory rights to request repair, replacement, a price reduction or termination of the contract, where provided by law.

The commercial warranty does not cover defects or damage directly caused by unauthorized repairs, modifications or components. This exclusion applies only where there is a connection with the reported issue and does not affect statutory rights for non-conformity not caused by that intervention. Under the commercial warranty, each eligible component may be replaced once, according to the coverage period. This rule does not limit the consumer’s statutory conformity remedies.

For commercial-warranty requests, Cyrusher may require the shipment to service to be prepaid and insured by the customer unless it confirms otherwise. For non-conformity covered by the statutory guarantee, the remedy is provided at no cost to the consumer, including necessary transport costs.

Warranty terms

Electric bicycles purchased from cyrusher.ro or an authorized Cyrusher seller by the original owner are covered against eligible defects in materials or workmanship according to the component periods below.

A) Two-year limited warranty

The motor, controller and frame are covered against eligible manufacturing defects in materials or workmanship for two years from the original purchase date, or for one replacement of the relevant item, whichever occurs first. This one-replacement rule applies only to the commercial warranty and does not limit statutory conformity remedies.

B) One-year limited warranty

Lithium-ion batteries, hydraulic brakes, front fork and rear shock, bike computer or display, pedal-assist sensor, battery charger, rims, stem, handlebars, headset, seat post, bottom bracket, crankset, rear rack and shifting systems are covered against eligible manufacturing defects for one year from the original purchase date, or for one replacement of the relevant item, whichever occurs first. This one-replacement rule applies only to the commercial warranty and does not limit statutory conformity remedies.

Battery coverage does not include damage caused by power surges, an unsuitable charger, improper maintenance or misuse, normal wear and tear, or water damage.

C) No warranty

Gears, accessories, consumables and parts subject to normal wear and tear are excluded from this warranty unless a separate written warranty applies. Eligible returns may instead be governed by the Refund Policy.

How to claim warranty

Contact customer@cyrusher.com with a description of the problem and proof of purchase, including the order number, purchase date and purchase channel. For bicycles purchased after August 2022, provide the Cyrusher Global Tag, the unique authenticity number located on the rear of the bicycle frame. Cyrusher will review the case and guide you through the resolution process.

What will we do?

If a component is confirmed defective or damaged without user error, Cyrusher will issue an eligible replacement part and assist with replacement instructions. Parts confirmed as damaged in transit may also be replaced. If the product cannot be repaired after a reasonable number of attempts determined by Cyrusher, a replacement product may be provided.

What will we not do?

Cyrusher may request photos, video or other technical evidence to assess a commercial-warranty request. Missing materials may delay the commercial evaluation, but do not prevent notifying a non-conformity or condition the exercise of statutory rights. The commercial warranty applies to the original owner and eligible products purchased from cyrusher.ro or an authorized Cyrusher seller.

Third-party labor or replacement parts are not reimbursed under the commercial warranty unless Cyrusher approved them before the repair. For commercial-warranty requests, return shipping may be charged to the customer unless Cyrusher confirms otherwise. For statutory non-conformity, necessary transport costs are provided without charge to the consumer.

Claims

All warranty claims must be submitted through Cyrusher and include proof of purchase. Contact Customer Service before opening a claim because the issue may have a simple solution. Claims must be made within the applicable coverage period and can be sent to customer@cyrusher.com.

Shipping damage claims

Inspect every product immediately on delivery. Note visible damage on the waybill before you and the driver sign for the shipment. Photograph and, where possible, date all evidence. Keep the product, packaging and documents until inspection is complete.

Notify Cyrusher as soon as possible and within five days of delivery. In every case, a formal shipping-damage claim must be submitted to customer@cyrusher.com no later than 14 days after delivery; claims received later may be rejected.

Credit-card chargebacks

If an unresolved chargeback exists, processing of a commercial-warranty request may be suspended until payment is clarified. This does not suspend or limit statutory rights concerning product non-conformity.
